Important Legal Update: Constitutional Court Refuses SALGBC Leave to Appeal in Retirement Fund Accreditation Matter

Dear MEPF Members,

The Constitutional Court has refused SALGBC’s application for leave to appeal, bringing an important legal matter concerning the accreditation process for retirement funds to a close.

The dispute arose following the implementation of the Retirement Fund Collective Agreement, which introduced a compulsory accreditation process. Municipal Employees Pension Fund (MEPF) and Akani Retirement Fund Administrators challenged the process in the High Court and succeeded. The Supreme Court of Appeal dismissed SALGBC’s appeal, and the Constitutional Court has now refused leave to appeal.

The ruling upholds the finding that the compulsory implementation of the accreditation process was unlawful. MEPF successfully defended the matter.
